Formidable Hosting Terms and Conditions

1. Acceptance of Terms

By accessing and using Formidable Hosting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Refunds & Payments

All virtual private servers (VPS) and dedicated servers are to be paid for in advance. Failure to maintain monthly payments on your server(s) may result in suspension and ultimately deletion of your service(s).

If you decide to cancel a subscription with us, please remember to cancel your payment subscription through your payment provider, which in some cases does not automatically cancel. Formidable Hosting is able to refund all overpayments if the subscription cancellation fails.

Should you need to raise a payment dispute, the suspension of your service may be implemented whilst the investigation is progressing.

No personal credit or debit card details are retained by Formidable Hosting directly. All payments are securely processed through Stripe.

Refunds are issued only as a result of issues which result in the complete failure of your service to operate. Refunds under these circumstances will be proportional to the period of time the service has been unusable.

Eligible services, as described above, will be deemed ineligible for refunds in cases where they are employed for illegal or malicious activities.

All dedicated servers are treated as business-to-business transactions and are non-refundable due to their reseller nature. This means no refunds can be given for dedicated server services.

The invoice charge will be placed 2 days before the actual due date to avoid late payments on automatic renewals. You have until the due date to pay. If payment is not received 2 days after the final date, the service is suspended, and the system will automatically generate a late fee of up to 10%. This only applies to services that are still active.

At our discretion, we reserve the right to refuse the renewal of services for any reason.

3. Service Usage

You agree to use our services only for lawful purposes and in accordance with our Fair Usage Policy. You are responsible for:

• All content stored on or transmitted through your VPS
• Maintaining the security of your account credentials
• All activities conducted through your account
• Ensuring compliance with all applicable laws and regulations

4. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Formidable Hosting reserves the right to perform maintenance, updates, and modifications that may temporarily affect service availability.

5. Account Termination

We reserve the right to suspend or terminate your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of our Fair Usage Policy
• Non-payment of fees
• Illegal activities or content

No refunds will be provided for terminated accounts.

6. Limitation of Liability

Formidable Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services. Our total liability shall not exceed the amount paid by you for the services in the three months preceding the claim.

7. Payment Terms

All fees are payable in advance. Failure to pay fees by the due date may result in service suspension or termination. All payments are processed securely through Stripe.

8. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any modifications.
